The Trump administration is reportedly considering whether to release the audio recordings of Joe Biden’s interview with Special Counsel Robert Hur publicly. The interview, conducted during Hur’s investigation into Biden’s handling of classified documents, has become a political flashpoint—especially after Hur raised questions about Biden’s memory, describing him as a “well-meaning, elderly man with a poor memory.”
According to Politico, which broke the news on Wednesday, Biden’s team is preparing for the potential release, although no final decision has yet been made. The recordings, if made public, are expected to reignite fierce political debate as the 2024 election season heats up.

The possibility of a public release has long been anticipated by supporters of former President Donald Trump. “The Hur audio will confirm what is one of the biggest cover-ups in American history,” said Mike Davis, a far-right legal activist and vocal Trump ally, in a statement to Politico.
Biden had previously tried to block the audio recordings from becoming public. In 2023, the White House invoked executive privilege in an effort to prevent House committees from accessing the tapes. The administration argued that releasing the recordings could discourage future witnesses in sensitive federal investigations and could infringe upon the president’s privacy rights.

However, mounting legal pressure may soon bring the issue to a head. Several conservative groups, including Judicial Watch and the Heritage Foundation, as well as various media organizations, have filed Freedom of Information Act (FOIA) lawsuits demanding access to the tapes. A federal judge has now ordered the Department of Justice (DOJ) to clarify its position: will it continue to uphold Biden’s executive privilege claim, or will it allow the tapes to be released?

“In separate Freedom of Information Act lawsuits brought by conservative groups like Judicial Watch and the Heritage Foundation and various news organizations, the Justice Department has been ordered by a judge to say whether it will stand by Biden’s assertion of executive privilege to block the release of the tapes,” Politico reported.

The DOJ must also explain whether it intends to pursue additional legal arguments against releasing the recordings, such as concerns that making them public could invade President Biden’s privacy or discourage cooperation from high-level officials in future investigations. With public scrutiny intensifying and legal deadlines looming, the fate of the Biden-Harris audio tapes remains uncertain—but politically explosive.
